Don’t let a workers’ compensation denial get you down

On Behalf of | Jul 13, 2019 | Firm News

An on-the-job injury can change your life in an instant. While you’re facing many challenges, the opportunity to obtain workers’ compensation benefits can help stabilize your finances during this difficult time.

Unfortunately, filing a claim for benefits doesn’t necessarily result in an approval. It’s possible you could receive a denial letter, which puts you in a difficult spot.

As frustrating as it may be, don’t let a denial get you down. You have legal rights and there are steps you can take to protect them.

Before we discuss your options to appeal a workers’ compensation denial, let’s review some of the most common reasons for this:

  • Failure to report the injury to your employer in a timely manner
  • Failure to receive medical attention after your injury
  • Your employer disputes your claim, typically stating that you did not suffer the injury on the job
  • Failure to file your claim in a timely manner
  • Unable to prove that the injury or illness is work-related

In some cases, appealing a workers’ compensation denial is as simple as providing additional information, such as medical records. Conversely, there are times when the appeals process is much more detailed.

Once you review your denial letter in great detail, you’ll have a clear idea of how to file an appeal. This is a good time to also collect all documentation related to your accident and injuries, such as medical records and statements from witnesses.

In addition to workers’ compensation benefits, you may also be able to seek Social Security disability or compensation through a third party liability claim. For example, if you’re injured in a motor vehicle accident while on the clock, workers’ compensation and a third party liability claim should both come into play.

You hope that you never suffer an injury at work, but this can happen at any time. Furthermore, you don’t have to work in a dangerous industry to suffer an injury.

If you’re injured on the job, stop what you’re doing, report the incident to your employer and receive immediate medical care. Taking these steps will put you in better position should you decide to file a claim for workers’ compensation benefits.
